Starting from 9.00 AM on March 27, 2023, all requests for seasonal or non-seasonal work can be submitted under the Decreto Flussi program, in accordance with the conditions. This is 60 days after the official announcement of the Decreto Flussi program by the Italian government. Eligible applicants can submit their requests starting March 27, or their authorized representatives can do it on their behalf.

This immigration program is also known as the seasonal work program or the Italy immigration program, which provides a 9-month work visa for applicants seeking seasonal work after being promoted by the Italian government.

The government has made some important changes to the Decreto Flussi program this year. First, requests submitted without any objections will be automatically processed and sent to the relevant Italian consular missions after 15 days. This will be done electronically and will allow for the issuance of work visas for 9 months. The relevant requests will be sent within 15 days.

Second, before applying for the permit to carry out the next change, the employer must confirm in the employment center that there is no other existing worker available to carry out the same job in the national territory, and that they need to resort to hiring a foreign worker residing outside the national territory to perform the job. This confirmation must be done by using the appropriate certification form and communicating the request to the employment center.

Furthermore, the authorization request can only proceed if:

  • The request is not answered by the Employment Center within 15 working days from the date it was submitted.
  • The worker proposed by the Employment Center is deemed inappropriate for the job position offered by the employer.
  • The worker assigned by the employment center fails to attend the selection interview unless there is a legitimate excuse, within at least twenty working days from the date of the request.
  • The evidence of the above circumstances must be shown through a self-certification that the employer must include with the work permit application.

This precautionary self-certification is not necessary for seasonal workers and trained workers abroad.

The new regulation has set a maximum quota of 82,705 workers. Out of the total quota, 44,000 are specifically earmarked for seasonal workers. 500 quotas are for daily workers, including those who are starting a business, professionals, well-known artisans, chairmen of Italian companies, CEO’s, board of directors of the companies, and auditors with at least 3 years of experience.

Additionally, 7,000 non-resident citizens are specifically authorized to apply for exchange permits, who previously hold an EU or Italian residence permit for study, seasonal work, or freelance activities, with the intention of converting their current permit to employment/self-employment permit. Approximately 31,205 quotas are available for work purposes, but only for specific recreational sectors and specific nationalities. These sectors include road transport, construction, and tourism-hotel sectors, as well as new sectors such as mechanics, telecommunications, food, and shipbuilding this year.
